Tierney fends off Hudak subpoena

LAWRENCE — Judge Robert Cornetta today quashed a subpoena that would have forced Congressman John Tierney to testify in a suit brought by challenger Bill Hudak seeking to stop the Salem Democrat from using what Hudak says is a libelous TV campaign ad.

The decision means Tierney will not have to testify this afternoon.

Tierney had filed an emergency motion to quash the subpoena, which Cornetta allowed after a hearing today in Lawrence Superior Court.

Hudak, a Boxford Republican, contends in a law suit filed Monday that Tierney’s ad falsely claims that Hudak wants to “shift the tax burden from the wealthiest to the middle class” and “eliminate the home mortgage deduction.”
