Rape charge against Wenham man dismissed

DANVERS — Charges of rape and indecent assault and battery against a Wenham man were dismissed Monday.

John Acciavatti, 53, of 207 Topsfield Road, Wenham, was charged in March after a man he knew from the gym they both attended went to police, reporting that Acciavatti had sexually assaulted him.

The man told police that Acciavatti, who is not a licensed massage therapist, invited him to a massage studio in Danvers where, he said he was told, Acciavatti would give him a massage.

Instead, the man told authorities, Acciavatti took the opportunity to sexually assault him.

The case had been scheduled several times, including Monday, for a probable cause hearing.

On Monday, a prosecutor asked that the case be dismissed, a request that was granted by the court, according to court records and a spokeswoman for the Essex County district attorney.
