Woman arraigned in scooter crash

SALEM — A Peabody woman was arraigned yesterday on drunken-driving charges, following an accident last weekend that seriously injured a Lynn man on a scooter.

Beth MacGillivary, 25, of 91 Lake St. pleaded not guilty in Salem Superior Court. Judge Richard Mori set bail at $2,500.

She was arrested at the scene on charges of drunken driving (second offense) and drunken driving resulting in serious bodily injury.

The charges stem from a 1:25 a.m. accident Saturday on North Street (Route 114) near the intersection with Liberty Hill Avenue.

The accident victim, Chris Rybicki, 39, of Lynn, was riding a scooter on Liberty Hill Avenue when it collided with a 2008 Volkswagen Passat driven by MacGillivary, according to police.

Rybicki was listed in serious condition yesterday at Massachusetts General Hospital in Boston. His condition had been downgraded from critical.

MacGillivary failed two field sobriety tests and had a blood alcohol level of .17, more than twice the legal limit, police said.

Judge Mori imposed a curfew and ordered MacGillivary to attend an outpatient substance abuse program and to be subject to random screenings.
